Article 1 – Definitions

In these General Terms and Conditions of Sale, the following terms have the meanings indicated:

Consumer: Any natural person acting for purposes outside their trade, business, craft, or profession, and entering into a distance contract with Olivia Bela-Bela.
Professional: Any natural or legal person offering products remotely to consumers, referred to herein as Olivia Bela-Bela.
Distance contract: Any contract concluded between Olivia Bela-Bela and the consumer within the framework of an organized distance selling system, without the simultaneous physical presence of the parties.
Right of withdrawal: The consumer's right to withdraw from a distance contract within a specified legal period.
Business day: Any day other than Saturday, Sunday, and public holidays.
Means of distance communication: Any means enabling the conclusion of a contract without the physical presence of the parties (website, email, etc.).

Before any contract is concluded, these conditions are made available to the consumer in accordance with applicable law.

All orders imply unreserved acceptance of these Terms and Conditions. In the event of a dispute, the provisions most favorable to the consumer will prevail.

ARTICLE 3 – OUR PRODUCTS

We have made every effort to accurately represent our products and services. However, colors or appearance may differ depending on your screen and its settings.

We do not guarantee that the products will exactly meet your expectations.

Descriptions are subject to change at any time without notice. We may withdraw a product or limit quantities per person, region, or jurisdiction.

ARTICLE 4 – ORDERS

When you place an order, you are making an offer to purchase. Olivia Bela-Bela reserves the right to accept or refuse any order. The order is only valid after written confirmation.

Payment must be received before validation.

Please check your order before submitting it, as it may not be possible to cancel it after confirmation.

You declare that your purchases are for personal use and not for resale.

4.1 – Order Modification

After confirmation, you have a maximum of 1 hour to request a modification (address, products, sizes or colors).

You must contact customer service at:
📧 info@oliviabela-bela.com, indicating the order number and the desired modification.

After this period, the order enters logistical processing and can no longer be modified.

Olivia Bela-Bela does not guarantee the modification, even within the time frame, as this depends on the order status and stock availability.

If the order has already been shipped, no changes are possible. You will have to wait for delivery and, if necessary, submit a return request.

Article 5 – Right of withdrawal

The consumer has 14 days from the date of receipt of the products to exercise their right of withdrawal, without having to justify their decision.

Olivia Bela-Bela grants, as a commercial gesture, an extended period of 30 days from receipt.

5.1 – Procedures for exercising the right

To exercise their right of withdrawal, the consumer must notify their decision clearly and unambiguously by one of the following means:

• Full name
• Order number
• Products to be returned

The consumer may use the model withdrawal form provided for by European legislation, although this is not mandatory.

5.2 – Return Conditions

The products must be returned:

• Not used
• Unwashed
• In their original packaging
• With tags and accessories intact

The consumer must return the products within a maximum of 14 days following notification of withdrawal .

Return shipping costs are the responsibility of the consumer, except in the case of an error on the part of Olivia Bela-Bela (defective or incorrect product).

5.3 – Reimbursement

In the event of exercising the right of withdrawal, Olivia Bela-Bela will reimburse all payments received from the consumer, including:

• The price of the products
• Standard delivery charges (excluding additional costs resulting from choosing a delivery method other than the standard method offered)

The refund will be made within a maximum of 14 days from the date on which Olivia Bela-Bela is informed of the withdrawal decision.

However, Olivia Bela-Bela may defer reimbursement until the goods are recovered or until the consumer provides proof of shipment of the goods, whichever occurs first.

The refund will be made using the same payment method as that used for the initial transaction, unless the consumer expressly agrees to another method.

5.4 – Exclusions

The right of withdrawal does not apply to the following products:

• Custom items
• Sealed products that cannot be returned for hygiene reasons and that have been unsealed after delivery
• Items are final sale or on promotion, duly identified.

ARTICLE 6 – PRICE AND INVOICING

Prices are subject to change without notice. The applicable price is the one in effect at the time of ordering.

Unless otherwise stated, prices do not include taxes, delivery charges or customs duties.

You agree to provide accurate and up-to-date information.

You guarantee that:

• Your payment details are valid.
• you are authorized to use them
• Payments will be honored.

ARTICLE 7 – SHIPPING AND DELIVERY

We are not responsible for delays. Delivery times are indicative only.

The risk is transferred to the consumer at the moment they take physical possession of the products.

Article 8 – Payment

Payment is required immediately.

Accepted methods:

• Bank card
• PayPal
• Other secure methods

The data is not stored.

Article 9 – Delivery

The products are sent to the address provided.

Time limit :

• EU: 5 to 10 business days
• International: 7 to 14 days

Delays may occur.

ARTICLE 10 – INTELLECTUAL PROPERTY

All content belongs to Olivia Bela-Bela.

Any reproduction without authorization is prohibited.

Article 11 – Conformity and Warranty

The products comply with the legislation.

In case of a defect:

• Report within 5 days
• provide photos

Article 12 – Limitation of Liability

Olivia Bela-Bela is not responsible for indirect damages.

ARTICLE 13 – OPTIONAL TOOLS

Third-party tools may be offered without warranty.

ARTICLE 14 – THIRD-PARTY LINKS

We are not responsible for external sites.

ARTICLE 15 – PRIVACY POLICY

The data is processed in accordance with the GDPR.
